[2] [2] El trazo actual en cuadrículas rectangular, adoptadas por los españoles para las ciudades del Nuevo Mundo, fue copiado del trazo de los municipios españoles. A su vez, éstos copiaban en su trazo a las ciudades romanas, que heredaron el trazo de las ciudades griegas. Hipodamo de Mileto, el primer urbanista del mundo hizo el trazo de las ciudades de Rodas en la isla del mismo modo rectangular, 300 años antes de Cristo. [3] [3] El factor que más contribuyó quizá, a la multiplicación del vínculo de motor, fue la II Guerra Mundial, el deseo de aprovechar las fábricas bélicas y la necesidad de dar empleo en la posguerra formaron la producción masiva de automóviles y empezó la acelerada motorización de los países más adelantados. Este fenómeno continúa hasta nuestros días. [4] [4] Ya hace varias décadas el Comité de transportes del 8º Plan del gobierno de Francia, invocando la calidad de vida de los ciudadanos recomendó. "-La organización de los transportes urbanos debe fundamentarse en los desplazamientos de personas y no sobre los desplazamientos de vehículos. -El uso de los coches individuales debe ser limitado en los centros más densos de las ciudades y en las vías que llegan a estos centros. -En esas regiones los transportes colectivos, deben tener prioridad y sus condiciones de confort y eficiencia deben ser mejoradas. Es de urgencia reconquistar de la circulación automovilística los espacios necesarios a la circulación de peatones y ciclistas. -Conviene construir para los automóviles parques de disuasión en el límite de las zonas centrales de la ciudad. Parques en que los vehículos hagan su estacionamiento sin tener que ir al centro de la ciudad. -Los metros franceses deben desarrollar sus redes en razón de estos objetivos. No es tan solo desarrollar las redes, mas desarrollarlas teniendo en cuenta estos objetivos. -En las aglomeraciones importantes es recomendable recorrer a fórmulas menos onerosas de transportes colectivo como por ejemplo los tranvías, los trolebuses y los ómnibuses en sitios propios." [5] [5] Corte Constitucional. Sentencia T Magistrado Ponente, Alejandro Martínez Caballero. [6] [6] En la Sentencia T , con ponencia del Magistrado Vladimiro Naranjo, la Corte concluyó que la restricción del derecho a la circulación en determinado medio de transporte no constituía una vulneración del derecho a la libre circulación ya que éste bien podía ejercerse a través de otros medios de transporte. [7] [7] Esta Corporación ya ha advertido que la licencia de transporte público de pasajeros no genera derechos adquiridos. Así se lo expuso, por ejemplo, en la Sentencia C , con ponencia del Magistrado Vladimiro Naranjo Mesa: “No puede considerarse que el otorgamiento de licencias de funcionamiento para operar el servicio público de transporte genere derechos adquiridos a favor de los operadores de dicho servicio, entendiendo como tales -lo ha dicho la Corte- aquellos que "se entienden incorporados válida y definitivamente o pertenecen al patrimonio de una persona". Se trata simplemente de derechos temporales de operación, sujetos a las nuevas condiciones y modificaciones que se deriven de la regulación legal y reglamentaria, que busca, en todo caso, coordinarlos con los derechos e intereses de la comunidad; ello, como ya se ha explicado, encuentra respaldo constitucional en los principios fundantes y fines esenciales del Estado, como lo son la prevalencia del interés general y el bienestar y mejoramiento de la calidad de vida de la población”.
