WCO HS Seminar in place, date Cambios : PROGRESO TECNOLOGICO NUEVAS TENDENCIAS DE MERCADO/COMERCIO CLARIFICACION DE TEXTOS SIMPLIFICACIONES The following examples show other main sources of the amendments made to the Nomenclature : Technological progress : A modification of the structured nomenclature of heading 27.10, a new Subheading Note 5 to Chapter 27, a new heading and new Note 7 to Chapter 38 for biodiesel and mixtures thereof; amendment of the structured nomenclature of heading for nickel-metal hydride and lithium‑ion accumulators (storage batteries); revision of subheadings of heading for video game consoles and machines. Trade patterns : Deletion of 43 subheadings on account of the low volume of trade (see Annex A). Clarification of texts to ensure uniform application of the HS : Amendment of the text of Note 2 to Chapter 30 for “immunological products”; regrouping of sanitary towels (pads) and tampons, napkins and napkin liners for babies and similar articles, of any material, in heading Adaptation of the Nomenclature to reflect trade practice : new subheadings have been created for lilies (Lillium spp.) in heading 06.03, for non‑centrifugal cane sugar in heading 17.01, for sweetened dried cranberries and cranberry juice in headings and 20.09, respectively, for water pipe tobacco in heading 24.03, for wood‑pellets in heading 44.01, for passenger boarding bridges in heading and for unrecorded and recorded optical media in heading The amendments therefore reflect changes in trade and technology but, in addition, they reinforce the multipurpose nature of the Nomenclature by taking account of the needs of the various users. WCO HS Seminar in place, date RECOMENDACION de 26 Junio 2009 SA 2012 de modificaciones recomendadadas a la Nomenclatura del Sistema Armonizado RECOMENDACION de 26 Junio 2010 respecto a las modificaciones de la Nomenclatura del Sistema Armonizado (consecuenciales tras modificaciones via corrigendum tras RECOMENDACION del Consejo of 26 June 2009) The WCO Council adopted the draft Recommendation with amendments to the Harmonized System Nomenclature at its annual sessions in June 2009. The Recommendation was being promulgated under the provisions of Article 16 of the Harmonized System Convention. This implied that HS Contracting Parties had 6 months during which they could object to a recommended amendment. The Recommendation comprised 221 sets of recommended amendments The Recommendation with the HS 2012 amendments was the fifth to amend the HS, though it was only the fourth Recommendation to make major amendments to the HS since the WCO Council approved the Harmonized System Convention in 1983. The WCO Council, at its 115th/116th Sessions in June 2010, adopted the following amendments to the HS Nomenclature 2012 Edition: certain corrigendum amendments to the HS Nomenclature following the Council Recommendation of 26 June 2009 concerning the amendment of the HS Nomenclature; an Article 16 Council Recommendation concerning the amendment of the HS Nomenclature (consequential upon the corrigendum amendments following the Council Recommendation of 26 June 2009); The amendments are required in order to take account of the necessary alignment of the French and English texts of certain subheadings of headings to and of heading 96.19, and the creation of the new Note 1 to Chapter 42 and new Subheading Note 1 to Chapter 44. The Article 16 Recommendation concerning the legal requirements consequential upon the corrigendum amendments to the HS 2012 will enter into force on 1 January 2013, following the procedure established under Article 16 of the HS Convention. However, by applying the corrigendum procedure approved by the Council at its Sessions in June 2010, the amendments could enter into force on the 1st of January 2012 to reflect the situation as from that date. The WCO Council, at its Sessions in June 2010, also approved certain corrections to spelling of the scientific name for Alaska Pollack in the text of HS 2012 subheadings , , , and The correct scientific name for Alaska Pollack should read: “Theragra chalcogramma”. The Recommendation comprised 221 sets of recommended amendments The Recommendation with the HS 2012 amendments was the fifth to amend the HS, though it was only the fourth Recommendation to make major amendments to the HS since the WCO Council approved the Harmonized System Convention in Environmental and social issues of global concern are the major feature of the HS 2012 amendments, particularly the use of the HS as the standard for classifying and coding goods of specific importance to food security and the early warning data system of the United Nations’ Food and Agriculture Organization (FAO). The volume of amendments within, for instance, Chapter 3, for the separate identification of certain species of fish and crustaceans, molluscs and other aquatic invertebrates, is eye-catching. However, the modifications aim at improving the quality and precision of trade data in these commodities. The amendments include, inter alia, improved specifications for species from the Southern hemisphere. These amendments will enable economic trends in products other than those familiar to North Atlantic consumers to be monitored. In the same vein, new subheadings have been created for the separate identification of certain edible vegetables, roots and tubers, fruit and nuts, as well as cereals. HS 2012 also features new subheadings for specific chemicals controlled under the Rotterdam Convention and ozone-depleting substances controlled under the Montreal Protocol. All the accepted amendments will come into force on 1 January 2012. The Implementation period While January 2012 may seem far off, the WCO Secretariat is working on the development of requisite Correlation Tables between the old and new versions of the HS, and on updating HS publications, such as the Explanatory Notes, the Classification Opinions, the HS Commodity Database and the Alphabetical Index. Customs administrations also have a huge task to ensure timely implementation of HS 2012, as required by the HS Convention. They are therefore encouraged to begin the process of implementing HS 2012 in their national Customs tariff or statistical nomenclatures.
