All the accepted amendments will come into force on 1 January 2012. The Implementation period While January 2012 may seem far off, the WCO Secretariat is working on the development of requisite Correlation Tables between the old and new versions of the HS, and on updating HS publications, such as the Explanatory Notes, the Classification Opinions, the HS Commodity Database and the Alphabetical Index. Customs administrations also have a huge task to ensure timely implementation of HS 2012, as required by the HS Convention. Trade patterns : Deletion of 43 subheadings on account of the low volume of trade (see Annex A). Clarification of texts to ensure uniform application of the HS : Amendment of the text of Note 2 to Chapter 30 for “immunological products”; regrouping of sanitary towels (pads) and tampons, napkins and napkin liners for babies and similar articles, of any material, in heading Adaptation of the Nomenclature to reflect trade practice : new subheadings have been created for lilies (Lillium spp.) in heading 06.03, for non‑centrifugal cane sugar in heading 17.01, for sweetened dried cranberries and cranberry juice in headings and 20.09, respectively, for water pipe tobacco in heading 24.03, for wood‑pellets in heading 44.01, for passenger boarding bridges in heading and for unrecorded and recorded optical media in heading The amendments therefore reflect changes in trade and technology but, in addition, they reinforce the multipurpose nature of the Nomenclature by taking account of the needs of the various users. The Recommendation was being promulgated under the provisions of Article 16 of the Harmonized System Convention. This implied that HS Contracting Parties had 6 months during which they could object to a recommended amendment. The Recommendation comprised 221 sets of recommended amendments The Recommendation with the HS 2012 amendments was the fifth to amend the HS, though it was only the fourth Recommendation to make major amendments to the HS since the WCO Council approved the Harmonized System Convention in 1983. The WCO Council, at its 115th/116th Sessions in June 2010, adopted the following amendments to the HS Nomenclature 2012 Edition: certain corrigendum amendments to the HS Nomenclature following the Council Recommendation of 26 June 2009 concerning the amendment of the HS Nomenclature; an Article 16 Council Recommendation concerning the amendment of the HS Nomenclature (consequential upon the corrigendum amendments following the Council Recommendation of 26 June 2009); The amendments are required in order to take account of the necessary alignment of the French and English texts of certain subheadings of headings to and of heading 96.19, and the creation of the new Note 1 to Chapter 42 and new Subheading Note 1 to Chapter 44. The Article 16 Recommendation concerning the legal requirements consequential upon the corrigendum amendments to the HS 2012 will enter into force on 1 January 2013, following the procedure established under Article 16 of the HS Convention. However, by applying the corrigendum procedure approved by the Council at its Sessions in June 2010, the amendments could enter into force on the 1st of January 2012 to reflect the situation as from that date. Further simplification of the Nomenclature. Simplification does not necessarily mean the reduction of the number of headings and subheadings for products of which the trade volume is low. The Nomenclature could be further simplified by identifying and deleting the HS Codes representing low volume of trade, but also by creating new codes to group products together, which would facilitate classification. As an example, he gave the creation by the Committee of a new heading in Capítulo 96 for certain articles of hygiene for the purposes of HS 2012. He also noted in this connection that, as a further example, the Secretariat proposal for the simplification of the classification of printer cartridges, which was left over from the Fourth Review Cycle, could hopefully be finalised in the Fifth Review Cycle to clarify the classification of such products. The product was described Brazil as “a mixture of mono-alkyl esters of long chain fatty acids derived from vegetable oils or animal fats, which is a domestic renewable fuel for diesel engines (Doc.NS0106E1a). The Scientific Sub-Committee recommended the classification of biodiesel, as described by Brazil, in heading 38.24, and in the light of the increasing production of this product, suggested the creation of a specific code for biodiesel. It was also pointed out that there were two types of biodiesel – one being a mixture of different esters and the other a mixture of esters with diesel oils and this should be taken into account at the time of the creation of the new code (Doc.NS0112E1b, SSC/20 Report). The Committee in its March 2005 session classified biodiesel in heading 38.24, and to reflect its decision, decided to amend the Explanatory Notes and to issue a Classification Opinion. NR0710 – RSC/36) Hygiene absorbent products, such as infant diapers (napkins), adult incontinence products, feminine sanitary products, and the like are currently classifiable in the Harmonized System according to their constituent materials.  For example, they may fall in HS subheading , , , , , , or , as the case may be. Trade in these products is substantial.  In 2006 alone, U.S. imports under subheading (sanitary towels and tampons, napkins, and napkin liners for babies and similar sanitary articles) amounted to nearly US$845 million; under subheading , such imports into the United States totalled almost US$30 million.  U.S exports under these subheadings in 2006 amounted to US$550 million and US$38.5 million, respectively.  Given the world’s burgeoning population, the demand for these products will only continue to increase. In the past 40 years, the technology of such products has evolved from simple knit or woven cloth to cellulosic-wood-pulp-based products and super absorbent polymers (SAP) combined with plastics film and textile nonwovens.  Absorbent technology continues to evolve rapidly, with various materials from differing HS chapters and headings being combined into composite products, which likely will lead to difficulties in tariff classification in the future. For the sake of simplifying such classification, the United States Administration would ask that the Review Sub-Committee examine a proposal to create a single new heading to cover all these products, regardless of their composition.
