INTRODUCTION Today, crime is international and has no borders, whether in the Americas or in any other part of the world. We have made tremendous effort within the areas of mutual legal assistance in criminal matters and extradition, but nevertheless, there is still a lot to be done and we must continue to work and collaborate in a more effective manner for the good of the Americas, in order to fight crime together in the hemisphere. Our countries must strive to provide an appropriate mechanism that facilitates a climate of trust and cooperation in order to attain a better and more effective administration of justice. Mutual trust, credibility and integrity are the foundations and cornerstones for this cooperation. INFORME A LA REMJA VII PARA FORTALECER LA ASISTENCIA LEGAL MUTUA (ALM) Y EXTRADICION EN LAS AMERICAS I. INTRODUCCIÓN Hoy en día, el crimen es internacional y no respeta fronteras, sea en las Américas o en cualquier otro lugar. Hemos hecho tremendos esfuerzos en el contexto de ALM en materia penal y en extradición, sin embargo aun queda mucho trabajo que hacer y debemos continuar trabajando y colaborando de una manera más efectiva por el bien de las Américas, para combatir conjuntamente el crimen en el continente. Nuestros países, deben esforzarse en proveer un mecanismo apropiado para facilitar un clima de confianza y cooperación para proveer una mejor y más efectiva administración de justicia. Los fundamentos y piedras angulares de esta cooperación, son la mutua confianza, credibilidad e integridad.

2 In our countries, organized crime and other illicit activities are very present. Easy access to new technologies allows the criminal element to evade our juridical system. Nonetheless, the initiative of Mutual Legal Assistance and Extradition in the OAS is, at this moment, the best mechanism to fight crime, especially cross border crime. II. OBJECTIVE In order to reach this common goal, all members of the OAS need to establish a structure of cooperation and transparency among the member states of the OAS. In accordance with the mandate received by the REMJA and after many months of continued consultations, we have created the terms of reference for an organizational structure for Mutual Legal Assistance and Extradition in the Americas, which are annexed in this document. These terms establish the objectives to be reached with the institutionalization of the Working Group and establish a Support Unit for the Working Group (SUWG) that is to be dedicated to provide permanent assistance to the Working Group. El crimen organizado y otras actividades ilícitas están muy presentes en nuestros países. El fácil acceso a las nuevas tecnologías permite al elemento criminal de evadir nuestros sistemas jurídicos. Sin embargo, la iniciativa de la Asistencia Legal Mutua en materia penal y en extradición en la OEA, es en este momento, el mejor mecanismo para combatir el crimen, especialmente el crimen transnacional. II. OBJETIVO Para lograr este objetivo común, todos los miembros de la Asistencia Legal Mutua en materia penal y extradición tienen el anhelo de establecer una estructura de cooperación y transparencia entre los Estados miembros de la OEA. De acuerdo al mandato recibido por la REMJA VI y después de haber tenido tres meses de consultaciones continuas entre los miembros del Grupo de trabajo hemos creado los términos de referencia contenidos en este documento, fijando los objetivos a alcanzar con la institucionalización del Grupo de Trabajo de la ALM y establecer una UAGT dedicada a proveer asistencia de manera permanente al Grupo de Trabajo de la ALM. El Grupo de Trabajo ha sugerido soluciones a adoptar con miras de fortalecer e intensificar la asistencia legal mutua entre los estados miembros.

3 The Working Group has suggested adopting solutions that will strengthen and intensify mutual legal assistance and extradition among the member states. The Working Group intends to continue to build good relations among all the participants in the Americas while establishing a climate of trust and cooperation that the hemisphere needs. The Americas are ready and this will be another step in our permanent fight against international crime. III. MANDATE OF THE NETWORK OF MUTUAL LEGAL ASSISTANCE AND EXTRADITION IN THE AMERICAS The REMJA Working Group for Mutual Legal Assistance in Criminal Matters and Extradition is an entity that is recognized by the Ministers of Justice, by the Prosecutors General of the Americas (REMJA) and by the OAS. El Grupo de Trabajo tiene la intención de continuar edificando las buenas relaciones entre todos los participantes, en el área de las Américas, estableciendo el clima de confianza y cooperación que el continente necesita. América esta listo y este será otro paso adelante en nuestra lucha permanente contra el crimen internacional. III. MANDATO DE LA RED DE ASISTENCIA LEGAL MUTUA Y EXTRADICION EN LAS AMÉRICAS El Grupo de Trabajo de la REMJA para la Asistencia Legal Mutua en materia penal y extradición es una entidad reconocida por los Ministerios de la Justicia, Procuradores Generales de las Américas (REMJA) y la OEA. El Grupo de Trabajo es responsable de coordinar los temas de la ALM en la OEA.

4 The Working Group is responsible for coordinating the affairs of the Mutual Legal Assistance and Extradition in the OAS. The Working Group on mutual legal assistance in criminal matters and extradition, through its coordinator, will present a report to the OAS REMJA, to the General Assembly and/or to the Juridical- Political Committee as requested by the members of the Working Group. a) The functions of the Working Group are the following: To coordinate the development of Mutual Legal Assistance in criminal matters and Extradition in the hemisphere, on behalf of the OAS REMJA; El Grupo de Trabajo para la asistencia legal mutua en materia penal y en la extradición de la REMJA, a través de su coordinador presentará un informe a la OEA REMJA, a la Asamblea General y/o al Comité Jurídico-Político así como ha sido requerido por los miembros del Grupo de Trabajo de la ALM. a) Las funciones del Grupo de Trabajo son las siguientes: Coordinar el desarrollo de la ALM en materia Penal y Extradición en el continente, en nombre de la REMJA OEA;

5 To facilitate the exchange of information between the members of the OAS REMJA with the objective of improving the mechanisms for collaboration in Mutual Legal Assistance in criminal matters and Extradition; To take into account the initiatives for cooperation with the purpose of improving Mutual Legal Assistance in criminal matters and Extradition in the OAS REMJA; To facilitate the exchange of information and the understanding of good practices in the area of Mutual Legal Assistance in criminal matters and Extradition; To create points of contact with countries that are not members of the OAS and with other entities in the area of Mutual Legal Assistance in criminal matters and extradition ; Facilitar el intercambio de información entre los miembros de la REMJA OEA con el objeto de mejorar los mecanismos de colaboración en Asistencia Legal Mutua en materia Penal y en la Extradición; Considerar las iniciativas de cooperación con el objeto de mejorar la Asistencia Legal Mutua en materia penal y en la extradición en la REMJA OEA; Facilitar el intercambio de información y comprensión de las mejores prácticas en el área de la Asistencia Legal Mutua en materia penal y en la Extradición; Crear puntos de contacto con países no miembros de la OEA y otras entidades en el área de la Asistencia Legal Mutua en materia penal y en la extradición;

6 To identify common criteria among the members of the Working Group and to carry out the relevant propositions; The Working Group of experts will meet twice a year or more, if considered necessary by the members. b) Special meeting (extended invitation) : The coordinator Working Group together with the host country will duly invite, by way of the diplomatic missions, the Member States of the OAS at least 30 days prior to the special meeting; Identificar criterios comunes entre los miembros del Grupo de Trabajo y efectuar las proposiciones pertinentes; El Grupo de Trabajo de expertos tendrá dos reuniones por aňo o más, en el caso que fuere considerado necesario por sus miembros. b) Reunión especial (invitación cordial): El coordinador del Grupo de Trabajo conjuntamente con el país anfitrión, invitará debidamente a través de las misiones diplomáticas a los Estados Miembros de la OEA, por lo menos con 30 días de antelación a la reunión especial;

7 The special meeting will take place once every two years and whenever possible, a few months prior to the date set for the REMJA. This special meeting will have as its main objective to review the work and decisions of the Working Group and of the Sub-groups as well as to elect a coordinator and vice-coordinator for the Working Group; The term of office for the mandates of the coordinator and vice-coordinator is two years, with the possibility of re- election. Upon agreement of the members, the position may have a shorter term of office; The conclusions and results of the special meeting will be reported to the REMJA by the coordinator and, if considered necessary, the Working Group will inform other departments of the OAS. La reunión especial tendrá lugar una vez cada dos anos, en lo posible algunos meses antes de la fecha prevista para la REMJA. Esta reunión especial tendrá como objetivo principal revisar la labor y las decisiones del Grupo de Trabajo y de los Sub- grupos, además de elegir un Coordinador y un Vice-coordinador para el grupo de Trabajo; El tiempo del mandato para el Coordinador y el Vice-coordinador es de dos a ň os, reelegibles. Por acuerdo de los miembros, el cargo podrá ser por un tiempo menor; El resultado y conclusiones de la reunión especial será informado al REMJA a través de su coordinador, y en caso de considerarlo necesario el Grupo de Trabajo, informará a otros dependencias de la OEA.

8 c) Sub-Working Groups: The Working Group will be able to create Sub-Working Groups (SWG) when considered necessary in order to facilitate the progress of certain matters or to respond to the requirements of its members; The Working Group will issue a mandate for every SWG that is created; The Working Group will delegate the function of president to a member for each SWG; Each president will create reports for the Working Group. The Working Group will be allowed to ask the presidents to deliver their reports directly to the REMJA. c) Sub-Grupos de Trabajo: El Grupo de Trabajo de la OEA podrá crear Sub-grupos de Trabajo (SGT) cuando lo considere necesario para facilitar el progreso de ciertas materias o necesidades de sus miembros; El Grupo de Trabajo de la OEA emitirá un mandato para cada SGT creado; El Grupo de Trabajo de la OEA delegará a un miembro la función de Presidente para cada SGT; Cada Presidente elaborará informes para el Grupo de Trabajo. El Grupo de Trabajo podrá pedir a los Presidentes que entreguen directamente su informe a la REMJA.

[SUPPORT UNIT FOR THE WORKING GROUP (SUWG)] [SUPPORT FOR THE WORKING GROUP (SWG)] The OAS shall delegate to one or more individuals the mandate to support the requirements of the Working Group and/or of the special meeting. a)Specific Function of the SUWG The SUWG shall provide assistance to the Working Group and shall support its activities; The SUWG shall frequently present its points of view to the Working Group in regards to Mutual Legal Assistance in criminal matters and Extradition; IV. [UNIDAD DE APOYO AL GRUPO DE TRABAJO (UAGT)] [APOYO AL GRUPO DE TRABAJO - AGT ] La OEA delegará a uno o más individuos el mandato de apoyar las necesidades del Grupo de Trabajo y/o de la reunión especial. a)Función Específica de la UAGT La UAGT proveerá asistencia al Grupo de Trabajo y apoyará sus actividades; La UAGT presentará sus puntos de vista al Grupo de Trabajo en relación a la Asistencia Legal Mutua en materia penal y la Extradición de manera frecuente;

10 The SUWG shall act as a link between the mission of the OAS and the Working Group; The SUWG will participate in the search for financial support in order to support the activities of the Working Group; The SUWG shall present its report to the Juridical-Political Committee of the OAS, as well as to the REMJA. La UAGT actuara como enlace entre las misiones de la OEA y el Grupo de Trabajo; La UAGT participara en la búsqueda y canalización de fondos para apoyar las actividades del Grupo de Trabajo; La UAGT podrá presentar su informe al Comité Jurídico- Político de la OEA como también a la REMJA.

11 b) Internet Site The website includes public and private pages; It will be supported by the SUWG; The SUWG shall support the work and decisions of the Working Group in regards to the website; The Working Group shall make decisions concerning the information, upgrading, updating and design of the internet site; The SUWG shall present a report to the Working Group on its developments and requirements in regards to the public and private pages of the internet site. b) Sitio Internet El Sitio Web incluye páginas públicas y privadas; Será mantenido por la UAGT; La UAGT apoyará la labor y las decisiones del Grupo de Trabajo en relación al Sitio Web; El Grupo de Trabajo tomará las decisiones acerca de la información, modernización, actualización y arquitectura del Sitio Internet; La UAGT presentará un informe al Grupo de Trabajo de sus desarrollos y necesidades en relación a las páginas públicas y privadas del Sitio Internet.

12 c) Secure e-mail system Groove The secure e-mail system is supported, modernized and updated by the group of computer technicians of the OAS; The SUWG shall support the computer technicians and the Working Group in regards to the secure e-mail system; The users of the secure e-mail system shall respect the conditions of the user protocol; c) Correo electrónico seguro Groove El correo electrónico seguro es mantenido, modernizado y actualizado por el equipo de técnicos en informática de la OEA; La UAGT apoyará al equipo de técnicos en informática y al Grupo de Trabajo de la OEA en el contexto del correo electrónico seguro; Los usuarios del correo electrónico seguro deberán respetar las condiciones del protocolo del usuario;

13 The rules of the user protocol will occasionally be reviewed by the Working Group; The team of computer technicians of the OAS shall frequently provide a report to the Working Group; The team of computer technicians of the OAS may provide a report to the REMJA; All of the decisions concerning the secure e-mail system shall be approved by the Working Group. Las regulaciones del protocolo del usuario serán ocasionalmente revisadas por el Grupo de Trabajo; El equipo de técnicos en informática de la OEA proporcionará frecuentemente un informe al Grupo de Trabajo; El equipo de técnicos en informática de la OEA podrá proporcionar un informe a la REMJA; Todas las decisiones respecto el correo electrónico seguro deberán ser aprobadas por el Grupo de Trabajo.
