3 Exportación Temporal Régimen aduanero que permite la salida temporal al exterior de mercancías nacionales o nacionalizadas con la obligación de Reimportarlas en un plazo de 12 meses (contados a partir de la fecha del término del embarque de la mercancía), en el mismo estado o luego de haber sido sometidas a una reparación cambio o mejoramiento. 4 Exportación Temporal Podrán acogerse a este Régimen todas aquellas mercancías cuya salida del país no se encuentre prohibida ni restringida, salvo las que estén destinadas a exposiciones o certámenes de carácter cultural, artístico o deportivo que cuenten con el permiso respectivo. Este régimen, puede ser solicitado por cualquier persona natural o jurídica a través de una agencia de aduanas. Exportación Temporal para cambio de mercancía: Esta modalidad unicamente puede solicitarse dentro de los tres meses de producida una importación definitiva y en casos debidamente justificados. Exportación Temporal para reparación o mejoramiento: Reimportación sin pago de tributos, se da siempre y cuando la exportación temporal haya sido solicitada dentro de los tres meses de realizada la importación definitiva, solo se paga la tasa por reintegro de papel. Reimportación con pago de tributos, se da cuando la exportación temporal es solicitada después de los tres meses de nacionalizada una mercancía, o en los casos de envío de mercancía nacional aquí se cancela los tributos de importación tomando como base el valor CIF sobre el valor de la reparación. Exportación Temporal para su Reimportación en el mismo estado: Se da en los casos de mercancía que sale al exterior para una exhibición o préstamo. Exportación Temporal para perfeccionamiento pasivo: Consiste en enviar al exterior mercancía (insumos) para ser transformadas o elaboradas, existiendo un producto compensador final el cual es reimportado, cancelándose los tributos sobre el valor agregado. Adicionalmente, existe una modalidad de Exportación Temporal, producida después de realizada una exportación definitiva, este hecho se da cuando una mercancía no es aceptada en el país de destino por diversos motivos, tales como: Resultar prohibidas en destino. Declaración Única de Aduanas (DUA) de Importación, consignando el código correspondiente al régimen. Factura comercial o Declaración Jurada de Valor. Documento de transporte (Conocimiento de Embarque, Guía Aérea, Aviso Postal o Carta Porte, según el medio de transporte utilizado). DUA de importación definitiva y factura comercial, cuando se encuentre amparado en el articulo 66º de la Ley General de Aduanas - D. Leg. Nº 809. 11 Regularización del Régimen
Dentro del plazo: Mediante la Reimportación de la mercancía. Mediante la Exportación definitiva de la mercancía. Fuera del plazo: La regularización es automática, es decir, si vencido el plazo de los 12 meses no se ha realizado la reimportación, esta se considera automáticamente exportada y se aplica la multa correspondiente.
