Portabilidad Numérica Mejores prácticas internacionales de recuperación de Costos

OBJETIVO El objetivo, considerando las mejores prácticas internacionales, es que con las Reglas de Portabilidad se promueva la competencia, se cumplan los objetivos de la Ley y que no ponga el riesgo el éxito de la implantación de la portabilidad.

PRINCIPIOS DE RECUPERACIÓN DE COSTOS Los órganos reguladores de diversos países han identificado los siguientes principios para una política de recuperación de los costos de portabilidad. Minimización de costos: La política de recuperación le debe dar incentivos a los operadores de utilizar las soluciones técnicamente mas eficientes y de ese modo minimizar los costos de la portabilidad numérica. Externalidades: Algunos de los beneficios que obtienen los usuarios que portan su número se extienden a los usuarios que no lo portan por el efecto de una mayor competencia en el mercado. Promoción de la competencia: La política de recuperación de inversiones no debe establecer cargos a los operadores o a los usuarios que limiten los beneficios de una mayor competencia en el mercado.

COSTOS DE ESTABLECIMIENTO DE LA PORTABILIDAD Costos de adaptación de las redes de los operadores, estos incluyen: Hardware y software adicionales. Bases de datos de portabilidad por operador. Costos adicionales en señalización y transporte. Se incurre en estos costos por el hecho de participar en un mercado en el que existe la portabilidad numérica. Son necesarios para que cada operador sea capaz de enrutar correctamente las llamadas que originan sus propios usuarios. Son independientes de la cantidad de usuarios que porten su número, por lo que no son causados por ellos. Existe consenso internacional en que cada uno de los operadores debe recuperar por si mismo este tipo de costos, sin cargos a otros operadores ni a los usuarios que porten su número.

DETERMINACIÓN DE POLITICAS DE RECUPERACIÓN DE COSTOS DE ESTABLECIMIENTO EN PAÍSES SELECCIONADOS En el ámbito internacional los órganos reguladores se han pronunciado por que cada operador soporte sus propios costos de establecimiento: Italia ( Resolution no. 4/CIR/99) : “ […] 2. Each telecommunications operator that is required to provide Service Provider Portability is responsible for costs incurred for the adaptation of the system under paragraph 1 letter a), without the possibility of a method for recovering them as additional costs for the service. […]” Nueva Zelanda ( Decision 554 ): “[…] 128. Per-operator set-up costs are not driven by porting customers and will be incurred irrespective of whether customers port their numbers. Rather, these costs are part of the investment that any operator needs to incur in order to provide telecommunications services in a competitive market. The origin or cause of these costs could be traced back to the government decision to regulate number portability. […]” Portugal (Portability regulations) : “[…] 1. The cost of establishing systems associated with the introductions or modifications to be made in the networks and systems of each company and with other procedures associated with portability must be borne by each company in its network and systems. […]”

Reino Unido (Inquiry by the monopolies and mergers commission): “[…] 13. In order to understand the recommendations, it is necessary to distinguish between the different categories of costs arising from portability. All operators who wish to provide portability will incur what are termed ''System set-up costs'. These are the basic costs of establishing the ability to port numbers from one network to another. Under the existing licence, BT could recover these in full. Oftel's view prior to the making of the reference was that each operator should bear its own costs in this category. This would contribute towards an appropriate balance of cost-recovery between BT and other operators, and would also be the most practicable method of apportionment. The MMC concurred with this view, noting that BT had also made clear that it was prepared to bear these costs itself. […]” Sudáfrica ( Government Gazette, 30 September 2005) : “[…] An operator that is required to provide number portability shall bear its own set-up costs and all originating operators shall bear any set-up cost that are incurred as a consequence of regulation. […]” República Dominicana ( Resolución No ) : “[…] 9.1 Los costos derivados de la actualización de los elementos de red y de los sistemas necesarios para hacer operativa la portabilidad numérica deberán ser sufragados por cada prestadora del servicio público telefónico. […]”

Taiwan (Regulations Governing Number Portability) : “[…] Article 44: The Fixed Network Operator and the Mobile Operator shall bear its own set-up and maintenance costs incurred for implementing the Number Portability and providing communications services for the called Ported Subscribers. […]” Brasil (Consulta Pública 734) : “[...] Art. 59. Cada prestadora é responsável pelos custos necessários para adequação da sua própria rede, a fim de permitir a implementação da solução de Portabilidade e de suas atualizações. [...]” España (Real Decreto 1651/1998) : “[…] Artículo 25. Contraprestaciones económicas. 1. Los costes derivados de la actualización de los elementos de red y de los sistemas necesarios para hacer operativa la conservación de los números por los abonados deberán ser sufragados por cada entidad habilitada, no dando derecho a contraprestación económica alguna. […]”
