ANTECEDENTES DE REUNIONES DE AUTORIDADES CENTRALES Y DE RED, Y CONSIDERACIONES BACKGROUND ON THE MEETING OF CENTRAL AUTHORITIES AND THE NETWORK, AND CONSIDERATIONS: REMJA I (Buenos Aires, 1997): “5. La cooperación legal internacional es esencial para el desarrollo de los sistemas de justicia en los países miembros de la OEA. En consecuencia, de conformidad con la legislación de cada país, es necesario trabajar, entre otras acciones, en la promoción de la Asistencia Jurídica Mutua, efectiva y ágil, particularmente en lo que se refiere a las extradiciones, en la solicitud de entrega de documentos y otros medios de prueba, en el establecimiento de canales seguros y rápidos de comunicación como los de Interpol, así como en el fortalecimiento del papel de las Autoridades Centrales”. REMJA I (Buenos Aires, 1997): “5. International legal cooperation is essential for the development of justice systems within the member countries of the OAS. Consequently, and in accordance with each country’s legislation, there is a need to promote mutual legal assistance in a flexible and effective manner, in particular with respect to extradition, requests for delivery of documents and other forms of evidence, the establishment of secure and prompt channels of communications such as those of Interpol, and strengthening of the role of the Central Authorities.

REMJA II (Lima, Perú, 1999): REMJA II (Lima, Perú, 1999): “C. To continue working in an effective and flexible manner to strengthen mutual legal and judicial assistance among the OAS member states, particularly with respect to extradition, requests for delivery of documents and other forms of evidence and the establishment of secure and prompt channels of communications between Central Authorities.” “E. To urge OAS member states that are parties to treaties for legal and judicial cooperation to appoint Central Authorities where they have not yet done so, to ensure the effective implementation of these treaties.” “F. To recommend that the OAS convene a meeting of Central Authorities in due course to strengthen cooperation among those authorities in relation to the various conventions on the subject of legal and judicial cooperation.” REMJA II (Lima, Perú, 1999): “C. Continuar trabajando de manera efectiva y ágil en el fortalecimiento de la asistencia legal y judicial entre los Estados miembros de la OEA, particularmente en lo que se refiere a las extradiciones, a la solicitud de entrega de documentos y otros medios de prueba y a los canales de comunicación entre las Autoridades Centrales. “E. Exhortar a los Estados miembros de la OEA que son partes de las convenciones en materia de cooperación legal y judicial que, en los casos en que aún no lo hayan hecho, designen Autoridades Centrales para asegurar la efectiva aplicación de estos tratados. “F. Recomendar a la OEA que convoque oportunamente una reunión de Autoridades Centrales con el fin de fortalecer la cooperación entre las mismas en el marco de las diversas convenciones en materia de cooperación legal y judicial”.

REMJA III (Costa Rica, 2000): REMJA III (Costa Rica, 2000): “Decide establecer, para fortalecer la cooperación en este campo y la confianza mutua, una red de intercambio de información ...en materia de extradición y asistencia jurídica mutua... Dicha red, representativa de los diferentes sistemas jurídicos del hemisferio, deberá apoyarse en la medida de lo posible en los medios electrónicos de comunicación, en particular la Internet”. REMJA III (Costa Rica, 2000): “Resolves to strengthen cooperation and mutual confidence in this field by establishing an information network… in the area of extradition and mutual legal assistance…That network, fed by data from the different legal systems in the Hemisphere, should rely as far as possible on electronic communications media, especially the Internet.”

Años 2000-2001: Conformación de Grupo de Trabajo para la Red de Intercambio de Información: Argentina, Bahamas, Canadá y El Salvador; y Secretaría General de OEA. Tercera Cumbre de las Américas (Canadá, abril 2001): “Establecerán en la OEA una red de información, vía Internet, entre las autoridades jurídicas competentes en los temas de extradición y asistencia mutua legal …”. Desarrollo de fase piloto de la red (cuatro países y página pública) y presentación de resultados en la REMJA IV. Years 2000-2001: Composition of the Working Group for the Information Exchange Network: Argentina, The Bahamas, Canada and El Salvador; and the General Secretariat of the OAS. Third Summit of the Americas (Canada, April 2001) “Establish, in the OAS, an Internet-based network of information among competent legal authorities on extradition and mutual legal assistance…” - Development of the pilot phase of the network (four countries and the public page) and presentation of the results at REMJA IV.

REMJA IV (Trinidad and Tobago, 2002): “That the Working Group, made up of Argentina, The Bahamas, Canada, and El Salvador, with the support of the OAS General Secretariat, continue its activities so that said network may extend to all countries of the Americas.” “That a meeting of central authorities and other experts be held in the area of mutual legal assistance” to “analyze the challenges that all OAS member states have to encounter with regard to mutual legal assistance and to propose solutions” (reiterating the mandate from REMJA II).   REMJA IV (Trinidad y Tobago, 2002): “Que el Grupo de Trabajo, integrado por Argentina, Bahamas, Canadá y El Salvador, con el apoyo de la Secretaría General de la OEA, continúe sus actividades con el fin de que dicha red se extienda a todos los Estados de las Américas“. “Que se realice una reunión de autoridades centrales y otros expertos en materia de asistencia judicial mutua” para “analizar los desafíos que todos los Estados Miembros de la OEA tienen que enfrentar en materia de asistencia judicial mutua y proponer las correspondientes soluciones” (reiteración de mandato de REMJA II).

FIRST MEETING OF CENTRAL AUTHORITIES AND OTHER EXPERTS ON MLA: “Central authorities and other experts on mutual legal assistance in criminal matters of the OAS Member States, met in Ottawa, Canada, between April 30 to May 2, 2003, in accordance with the recommendations adopted in the Fourth Meeting of Ministers of Justice or of Ministers of Attorneys General of the Americas (REMJA-IV)… “The purpose of the meeting was to develop recommendations to strengthen and consolidate mutual legal assistance in criminal matters among the States of the Americas in order to combat transnational organized crime, money laundering and terrorism.” “Upon the conclusion of its deliberations, the meeting adopted the following recommendations to be presented for consideration by the Fifth Meeting of Ministers of Justice or of Ministers or Attorneys General of the Americas (REMJA-V).” PRIMERA REUNIÓN DE AUTORIDADES CENTRALES Y OTROS EXPERTOS AJM: “Las autoridades centrales y otros expertos en asistencia judicial mutua en materia penal de los Estados Miembros de la OEA, se reunieron en Ottawa, Canadá, entre los días 30 de abril y 2 de mayo de 2003, de acuerdo con las recomendaciones adoptadas en la Cuarta Reunión de Ministros de Justicia o de Ministros o Procuradores Generales de las Américas (REMJA-IV)... “El propósito de esta reunión fue el de desarrollar recomendaciones para fortalecer y consolidar la asistencia judicial mutua en materia penal entre los Estados de las Américas para combatir la delincuencia organizada transnacional, el lavado de dinero y el terrorismo. “Al terminar sus deliberaciones, las autoridades centrales y otros expertos en asistencia judicial mutua en materia penal adoptaron las siguientes recomendaciones para ser presentadas a consideración de la Quinta Reunión de Ministros de Justicia o de Ministros o Procuradores Generales de las Américas (REMJA-V).

REMJA V (Washington, 2004): “Support…the continued holding of meetings of the Central Authorities and other Experts on mutual legal assistance in criminal matters in the Hemisphere at least once between REMJAs, with the support and coordination of the Working Group on Mutual Legal Assistance, as well as consideration, at their next meeting, of both progress made in implementing the recommendation of the Ottawa meeting…” (Mention of the Group and limited mandate). “To decide that the next Meeting of Central Authorities and Other Experts start considering actions to build up hemispheric legal cooperation in the matter of extradition…” REMJA V (Washington, 2004): “Respaldar... la continua celebración de reuniones de las Autoridades Centrales y otros Expertos sobre asistencia judicial mutua en materia penal del Hemisferio, por lo menos una vez entre una REMJA y la siguiente y, con el apoyo y la coordinación del Grupo de Trabajo sobre Asistencia Judicial Mutua, la consideración, en su siguiente reunión, del avance logrado en cuanto a la aplicación de las recomendaciones de la reunión de Ottawa...”. (Mención a Grupo y mandato limitado).   “Decide que, en la próxima reunión de autoridades centrales y otros expertos, se inicie la consideración de acciones para fortalecer la cooperación jurídica hemisférica en materia de extradición...”.

“That, since the network, under the leadership of a group consisting of Argentina, Bahamas (The), Canada, and El Salvador, and administered by the OAS General Secretariat, comprises data on all OAS Member States, information related to mutual legal assistance in criminal matters…should continue to be posted on the public website.” “Establece, que como la red, bajo la orientación de un grupo formado por Argentina, Bahamas, Canadá y El Salvador y administrado por la Secretaría General de la OEA, comprende datos referentes a todos los Estados miembros de la OEA, en el sitio público en “Internet” debe seguir publicándose información referente a asistencia judicial mutua en materia penal...”.

Second Meeting of Central Authorities and Other Experts: The central authorities and other experts in mutual assistance in criminal matters and extradition of the OAS Member States, met in Brasilia, Brazil, between September 1-3, 2005, in accordance with what was established by the Fifth Meeting of Ministers of Justice or Attorneys General of the Americas (REMJA-V)… “At the conclusion of their deliberations, the central authorities and other experts on mutual assistance in criminal matters and extradition adopted the following recommendations, to be presented and considered at the Sixth Meeting of Ministers of Justice or of Ministers or Attorneys General of the Americas (REMJA-VI).” Segunda Reunión de Autoridades Centrales y otros expertos: Las autoridades centrales y otros expertos en asistencia mutua en materia penal y extradición de los Estados Miembros de la OEA, se reunieron en Brasilia, Brasil, entre los días 1 y 3 de septiembre de 2005, de conformidad con lo dispuesto por la Quinta Reunión de Ministros de Justicia o de Ministros o Procuradores Generales de las Américas (REMJA-V) .... “Al terminar sus deliberaciones, las autoridades centrales y otros expertos en asistencia mutua en materia penal y extradición adoptaron las siguientes recomendaciones, para su presentación a consideración de la Sexta Reunión de Ministros de Justicia o de Ministros o Procuradores Generales de las Américas (REMJA-VI)”.

Considerations based on the background: There has clearly been a distinction made between the network and the meeting of central authorities. The Mandates of the REMJA with respect to the network clearly refer to its consolidation as an information exchange network via the Internet (not to the holding of meetings). The Mandates of the REMJA with respect to the meetings of central authorities have to do with the holding of periodic meetings, in order to fulfill express mandates from the REMJA and report to the REMJA on their completion. Consideraciones con base en antecedentes: Evidentemente se ha hecho la distinción entre la red y la reunión de autoridades centrales. Los mandatos de las REMJA en relación con la red se refieren claramente a su consolidación como red de intercambio de información a través de “Internet” (no a la realización de reuniones). Los mandatos de las REMJA en relación con las reuniones de autoridades centrales tienen que ver con su celebración periódica, para cumplir mandatos expresos de la REMJA y reportarle sobre su cumplimiento.

- This occurred with the First Meeting (Ottawa) and this is anticipated with respect to the second (Brazil). The inclusion of the phrase in the REMJA V regarding the support and coordination of the Group (whose only function was related to the Network), has generated confusion: lead to the holding of prior meetings and has created a type of superposition between both processes. That mandate of support and coordination having been fulfilled by the holding of the Brasilia Meeting, there is a need to avoid repeating that “superposition” and confusion. Así ocurrió con la Primera Reunión (Ottawa) y así se ha previsto en relación con la segunda (Brasil). La inclusión de la frase en la REMJA V sobre el llamado apoyo y coordinación del Grupo (cuyo única función se relacionaba con la Red), ha generado confusión: llevo a la realización de reuniones previas y ha creado una especie de superposición entre ambos procesos. Agotado ese mandato de apoyo y coordinación con la realización de la Reunión de Brasilia, hay que evitar que esa especie de “superposición” y confusión se vuelvan a presentar.

To do so, we need only consolidate the process in the manner that has been repeatedly stipulated by the REMJA: The periodic meetings of the central authorities to carry out the REMJA mandates and report on their fulfillment with respect to cooperation on MLA and Extradition. The REMJA has stated at least one between one REMJA and the next. This is a minimum. The network as a system of information exchange via the Internet and taking advantage of all of its potential to minimize such frequent holding of meetings (with such high costs). Para ello sólo hay que consolidar el proceso en la forma en que lo ha venido disponiendo reiteradamente la REMJA: Las reuniones periódicas de las autoridades centrales para cumplir mandatos de la REMJA y reportar sobre su cumplimiento en relación con la cooperación en AJM y Extradición. La REMJA ha dicho que, por lo menos, una entre una y otra REMJA. Ese es un mínimo. La red como un sistema de intercambio de información a través de “Internet” y el aprovechamiento inclusive de todas sus potencialidades para minimizar la realización tan frecuente de reuniones (con costos tan altos).

II. EL MANDATO DEL PLAN DE ACCIÓN DE LA CUARTA CUMBRE DE LAS AMERICAS Y SU DESARROLLO/ THE MANDATE FROM THE PLAN OF ACTION FROM THE FOURTH SUMMIT OF THE AMERICAS AND ITS DEVELOPMENT The Plan of Action of the Fourth Summit of the Americas (Argentina, 2005): To consolidate the Hemispheric Information Exchange Network for Mutual Legal Assistance in Criminal Matters and Extradition, support the actions for the implementation of a strategic plan for the Justice Studies Center of the Americas (JSCA), and strengthen the institutional development of the General Secretariat of the OAS in these issues, in accordance with the framework of the Meetings of Ministers of Justice or of Ministers or Attorneys General of the Americas (REMJA). El Plan de Acción de la Cuarta Cumbre de las Américas (Argentina, 2005): “Consolidar la Red Hemisférica de Intercambio de Información para la Asistencia Judicial Mutua en Materia Penal y Extradición, apoyar las acciones para la implementación de un plan estratégico para el Centro de Estudios de Justicia de las Américas (CEJA) y fortalecer el desarrollo institucional de la Secretaria General de la OEA en estos temas, de conformidad con el marco de las Reuniones de Ministros de Justicia o de Ministros o Procuradores Generales de las Américas (REMJA).

Development of the Summit mandate: Desarrollo de mandato de la Cumbre: Executive Order 05-13 Rev.1 (February 14, 2006): - Establishment of the Office of Legal Cooperation in the Department of International Legal Affairs (did not exist under the previous structure) - Assignation of the following specific functions: (a) Advising and technical secretariat to the REMJA, meetings and groups within this framework. (b) technical secretariat to the Network. Focus of these functions (transfer of others to other areas: CIFTA, DIH). Strengthening of the office’s human resources (attorneys Regular Fund and external). Desarrollo de mandato de la Cumbre: Orden Ejecutiva O5-13 Rev.1 (14 Feb, 2006): Establecimiento de Oficina de Cooperación Jurídica en Departamento de Asuntos Jurídicos Internacionales (no existía bajo estructura anterior). Asignación de funciones expresas de: (a) Asesoría y secretaría técnica de REMJA, reuniones y grupos en ese marco. (b) secretaría técnica de la Red Focalización en estas funciones (transferencia de otras a otras áreas: CIFTA, DIH). Fortalecimiento de recursos humanos de Oficina (abogados Fondo Regular y externos).

III. MANDATOS EN EL MARCO DE LA REMJA, DESARROLLOS Y CONSIDERACIONES PARA CONTINUACIÓN/ MANDATES WITHIN THE FRAMEWORK OF THE REMJA AND CONSIDERATIONS FOR CONTINUING TO THE TECHNICAL SECRETARIAT Commonly used terms: progress document and follow-up for completion before the third Meeting (I, 2, c) Maintenance of the public and private webpages of the Network and requests for information to the States every four months to update the Network: progress, evaluation document and individual follow-up (IV.1). Information for “appropriate consideration [to] be given by REMJA VI to means by which the Network can be maintained and properly funded in the long term.” (preliminary information will be provided below); (IV.4) A SECRETARÍA TÉCNICA: Términos de uso común: documento de avance y seguimiento para cumplimiento antes de 3ª. Reunión (I, 2, c). Mantenimiento de componente público y privado de la Red y solicitud de información cada cuatro meses a los Estados para su actualización: avance, documento de evaluación y seguimiento individual (IV.1). Información para “que la REMJA VI pueda considerar los medios a través de los cuales la Red pueda ser mantenida y financiada apropiadamente a largo plazo” (se compartirá información preliminar adelante); (IV. 4).

Apoyo en evaluación del proyecto piloto de correo seguro (información recibida y análisis previsto). COLECTIVOS O A GRUPOS PARA 3ª.Y APOYO: Elaboración de guía de mejores prácticas (presentación a 3ª. Reunión). Elaboración de legislación modelo. Elaboración de guía de procedimientos en materia de extradición. Ofrecimiento de apoyo a coordinadores en integración de esas propuestas (funciones propias de Secretaría Técnica). Support in the evaluation of the secure e-mail pilot project (information received and analysis anticipated) COLLECTIVE OR TO GROUPS FOR THE THIRD MEETING AND SUPPORT: Preparation of a guide of best practices (presentation to the Third Meeting). Preparation of model legislation. Preparation of a guide of procedures in the area of extradition. Offering of support to coordinators in the integration of those proposals (functions of the Technical Secretariat).

TO THE STATES AND SUPPORT: Full implementation of the recommendations from the first and second meeting. Individual follow-up with each State. Analysis and collective and individual reports (example: document on a list of authorities; and analysis related to the status of ratification of treaties and the designation of central authorities). A LOS ESTADOS Y APOYO: Implementación integral de recomendaciones de primera y segunda reunión. Seguimiento individual con cada Estado.
