NAFTA’s Chapter 6 set the possibility of the gradual liberalization of Mexico’s energy sector: Privatization of the gas transportation grid, and crossborder trade is permitted under certain conditions. Private enterprises are allowed to produce electricity for self- supply, cogeneration, as an Independent Power Producer (IPP) or for import-export activities. However, sales and distribution remain under the monopoly of state enterprises. However, in case of an inconsistency, Mexico’s constitutional restrictions prevail. Thus, controversies are to be solved by the Supreme Court of Justice.
