COMMISSION REGULATION (EU) No 965/2012 of 5 October 2012 The operator shall establish procedures and instructions for the safe operation of each aircraft type, containing ground staff and crew member duties and responsibilities for all types of operation on the ground and in flight [ORO.GEN.110.(f)] A minimum equipment list (MEL) shall be established as specified under 8.a.3 of Annex IV to Regulation (EC) No 216/2008 [BASIC REGULATION - Essential requirements for air operations], based on the relevant master minimum equipment list (MMEL) as defined in the data established in accordance with Regulation (EC) No 1702/2003 [IR CERTIFICATION – PART 21]. The MEL and any amendment thereto shall be approved by the competent authority. [ORO.MLR.105 (a) (b)].

COMMISSION REGULATION (EU) No 965/2012 of 5 October 2012 In addition to the list of items, the MEL shall contain: (1) a preamble, including guidance and definitions for flight crews and maintenance personnel using the MEL; (2) ….; (3) the scope, extent and purpose of the MEL. [ORO.MLR.105 (d)].

COMMISSION REGULATION (EU) No 965/2012 of 5 October 2012 The operator shall establish the operational and maintenance procedures referenced in the MEL taking into account the operational and maintenance procedures referenced in the MMEL. These procedures shall be part of the operator’s manuals or the MEL. Unless otherwise specified in the MEL, the operator shall complete: (1) the operational procedures referenced in the MEL when planning for and/or operating with the listed item inoperative; and (2) the maintenance procedures referenced in the MEL prior to operating with the listed item inoperative [ORO.MLR.105 (g) (i) ]

COMMISSION REGULATION (EU) No 965/2012 of 5 October 2012 Minimum equipment for flight: A flight shall not be commenced when any of the aeroplane’s instruments, items of equipment or functions required for the intended flight are inoperative or missing, unless: (a) the aeroplane is operated in accordance with the operator’s MEL; or (b) the operator is approved by the competent authority to operate the aeroplane within the constraints of the MMEL [CAT.IDE.A-B.105]

REGLAMENTO (CE) N o 2042/2003 DE LA COMISIÓN de 20 de noviembre de 2003 Defectos de la aeronave a) Cualquier defecto de la aeronave que ponga en peligro seriamente la seguridad del vuelo rectificarse antes del vuelo. b) Únicamente el personal certificador autorizado puede decidir, usando datos de mantenimiento mencionados en M.A.401, si un determinado defecto de la aeronave pone en peligro seriamente la seguridad del vuelo, y por tanto decidir qué rectificación es necesaria y cuándo debería realizarse y qué rectificación puede posponerse. MEL procedures The MEL is intended to permit operation with inoperative items of system, function, or equipment for a period of time until repairs can be accomplished. It is important that repairs be accomplished at the earliest opportunity. When an item is discovered to be inoperative, it is reported by making an entry in the technical logbook. The item is then either rectified or may be deferred per the MEL before further operation. MEL conditions and limitations do not relieve the maintenace staff and flight crew from determining that the aircraft is in a fit condition for safe operation with items inoperative.

MEL procedures The decision of the Commander of the flight to have inoperative items corrected before the flight will take precedence over the provisions contained in the MEL. The Commander may request requirements above the minimum listed, whenever in his judgment such added equipment is essential to the safety of a particular flight under the special condition prevailing at the time.
