Future updates needed from Florida Department of Children & Families – During FY , the Florida Abuse Hotline received 47,261 reports of adult abuse, neglect and exploitation. 32,315 (68 percent) of these reports involved at least one victim age 60 or older. Handouts can be provided for statistical information.

This is evidenced by the increase in the number of reports each year. These numbers do not, however, reflect the actual number of victims. Nationally recognized experts estimate that for every one report there are 14 incidents that never come to the attention of authorities. On March 2, 2011, the U.S. Senate Special Committee on Aging heard the testimony of legendary entertainment celebrity Mickey Rooney about his experience as a victim of exploitation and emotional abuse. He is now an advocate for seniors across the nation and encourages them to speak out about their abuse and exploitation. Mickey Rooney’s last words to the public audience, “Don’t let it happen to you.” (Jim Toedtman, Editor, AARP Bulletin, April 2011 Vol. 52, No. 3) Our philosophy: “Education is the key to prevention” Elder abuse, neglect, and exploitation are health and human rights issues. ACTIVITY – if there are enough participants, have them count off by 15s. After everyone has counted, ask all the “number 15s” to stand. Have everyone take a look around the room and see that, for every one report filed, there are 14 that go unreported. All who are standing represent the one report, and all who are still seated represent the cases that go unreported.

The Long Term Care Ombudsman Program (LTCOP) is designed to protect the rights of long-term care facility residents through investigation of complaints and education. If abuse is suspected LTCOP will contact DCF/APS to further investigate. DCF Administers the abuse hotline and conducts investigations of suspected abuse, neglect (including self-neglect), and exploitation of vulnerable adults.

Chapter 415, entitled “Adult Protective Services” – provides the definitions of related terms for abuse, neglect and exploitation (i.e., caregiver, vulnerable adult, neglect, capacity, lacks capacity, etc.) and establishes everyone is a mandatory reporter. APS investigates allegations of abuse, neglect and exploitation of… individuals with disabilities age 18 and older individuals age 60 and older Chapter 825, entitled “Abuse, Neglect and Exploitation (ANE) of Elderly persons and disabled adults” – provides the penalties for ANE of such persons. These are felony charges when someone commits ANE against an elderly person or disabled adult.

The Department of Children and Families (DCF) is responsible for providing services to detect and correct abuse, neglect (including self-neglect), or exploitation of vulnerable adults who, because of their age or disability, may be unable to adequately provide for their own care or protection. The DCF Adult Protective Services Program is a system of specialized social services directed toward assisting vulnerable adults who are unable to manage their own affairs, carry out activities of daily living, or protect themselves from abuse, neglect, or exploitation. The four components of APS are: 1 - On site investigation of reports of alleged abuse, neglect (including self-neglect), or exploitation. 2 - Determination of immediate risk of the victim and provision of necessary emergency services. 3 – Evaluation of the need for ongoing protective supervision. 4 – Provision of ongoing protective services. An investigator will respond within 24 hours of an accepted report. For emergency situations/report investigators respond within 3 hours. FL Statute 415 indicates all citizens in Florida are mandatory reporters.

Sexual abuse does not include any act intended for a valid medical purpose or any act that may reasonably by construed to be a normal caregiving act or appropriate display of affection. Forcing a senior (vulnerable adult) to watch pornography (without their consent) is considered sexual abuse.

Notice – “…on the part of the caregiver or vulnerable adult.” Indicating the person themselves can be the perpetrator; therefore, they are “self-neglecting.”

Florida State Statutes (7)(a)(b) Some common scams generally committed by strangers to be aware (these scams are not investigated by DCF, but by local law enforcement because the perpetrator is a stranger): Granny scams: Someone pretends to be a relative (generally grandson/daughter) who is in trouble overseas and needs money sent right away. Canadian Lottery : Victims are asked to send money in order to collect their winnings in a lottery or sweepstakes. No one has to pay an up-front fee to receive real lottery or sweepstakes winnings. Advance Fee Scams: As with the lottery scam, victims are asked to put up money in order to collect a larger sum of money, or to provide a “good faith” deposit on a loan. Pigeon Drop: A con artist approaches the victim and tells them about a large sum of money he has found. He needs their money to secure the cash, and they’ll get a cut in return. Often, a second player, pretending not to know the first one, comes in as a "lawyer" or "banker" who confirms the story. They may actually show the victim some cash. Home Repair: Scammer makes unsolicited repairs and then demands cash, or claims to have made repairs when none were done. Identity Crime: Family members and caregivers get access to a security number, bank account number, credit card number, or even debit card and proceed to make purchases or take out cash. (DCF response) Investment Scams: Many seniors are conned into participating in investment strategies that were nothing more than “ponzi” or pyramid schemes. High pressure sales pitches to invest in products such as titanium futures or currency markets lure consumers with the promise of guaranteed returns. In some cases, even a legitimate investment, such as an annuity, is sold to a senior for whom the product is entirely inappropriate.

Future updates needed from Florida Department of Children & Families – In state fiscal year ,the Florida Department of Children & Families investigated 6,596 reports of exploitation of elderly victims. The average age was 84. The relationship of the perpetrator (in verified cases only for 09/10 SFY for exploitation) to the victim, in Institutional and In-Home reports: In institutional settings the perpetrator was an employee 93 percent of the time. In a home setting the perpetrator was a son/daughter 44 percent of the time.

Las personas vulnerables:

Basically, Lacks capacity or Unable to care for themselves due to their disability/infirmity (Activities of Daily Living – ADLs) “Vulnerable adult in need of services” by Florida Statute definition – means an adult who has been determined by a protective investigator to be suffering from the ill effects of neglect not caused by a second party perpetrator and is in need of protective or other services to prevent further harm.

Remember we all have the right to make bad decisions. A person who is a “hoarder” can have capacity and choose to live that way. It is his or her right. ACTIVITY – Case Scenario (an actual call, but name has been changed) Read the following to the audience: Taylor’s dad is age 72 and lives alone. A few months ago, his dad hired a new caregiver who is age 35 and who seemed to be doing a good job at taking care of his dad (Dad is happy). But, Taylor is concerned that his dad may be a victim of exploitation because Dad recently purchased a new car, home, motorcycle, and boat for the caregiver. He tells Taylor it’s none of his business how he spends his money. Ask the audience to tell you (either one person or as a class) whether or not this is a case of exploitation. Answer: Dad has the right to spend his money on whomever and whatever he wants because he has “capacity.” The family may not like it, and it was recommended that the family have a meeting with Dad to express their concerns. There is nothing anyone can do when an individual has capacity. Again, we have the right to make bad decisions.

In some circumstances, victims are considered to be vulnerable adults or to “lack capacity” while they are on their medication(s) even though they are lucid and have capacity while they are not on any meds (and vice-versa). Ask the audience - A person in a wheelchair who has capacity, but is unable to care for himself – is he a vulnerable adult? Answer: Yes. Because remember, by statute, a “vulnerable” adult is considered someone who is unable to care for him or herself (ADLs). AS TIME ALLOWS – use other scenarios. Even though this slide says “anyone over the age of 60” (for our purposes) remember APS investigates ALL reports for adults over the age of 18.

Family dynamics that may contribute to abuse: Lack of family support or isolation from others Caregivers who feel forced to provide care Too many people (or multi-generational) in a crowded home Marital conflict Financial problems Medical issues

Fearful that the family will force them to live in a nursing home. REMEMBER – you don’t have to prove it, if you suspect abuse, neglect and/or exploitation - REPORT IT! Let DCF investigate.

You can also help by: Learning effective interviewing techniques to get as much info. Learn about local support groups, counseling, or other available services in your area to which the victim can be referred. When in doubt – make the call and let the hotline experts decide if an investigation is needed

Answer: Because we are all mandatory reporters How do we report? Answer: Online, phone, or fax with as much detail as possible. (I know this is a repeat, but it never hurts to hear it again.)
