The aim of these presentation is to explain the new rules adopted by the Council of Ministers of Spain, last March 11, to regulate the recreational sea fishing in in offshore waters. This new regulation is as a Royal Decree and depends on the same regulatory basis previously established in other lower-level regulations.

2 NECESIDAD DE ELABORACION
DEL REAL DECRETO Establecer un régimen general para regular el ejercicio de la pesca marítima recreativa en aguas exteriores en sus diferentes modalidades. CONSECUENCIA DEL Desarrollo en el sector turístico de la modalidad de pesca recreativa Incidencia en los recursos y en la actividad de la pesca profesional This RD is made taking into account the need to establish a general regime governing the exercise of recreational sea fishing in offshore waters in its various forms and in all fishing areas within the State. It also takes into account the development of tourism in Spain that promotes the growth of vessels engaged in this activity for recreational fishing. Therefore control is required in the incidence of this activity on marine resources and commercial fishing

3 Estructura del Real Decreto
Preámbulo 23 Artículos 5 Disposiciones adicionales 1 Disposición Transitoria Única 1 Disposición Derogatoria 3 Disposiciones Finales The RD comprised a preamble, that sets the requirements and specifications under which the RD has been issued, and 23 articles, divided into chapters. Chapter 1 General Provisions, the C2 System of protection and conservation (species and technical measures) C3 Recreational sea land fishing, C4 Recreational sea boat fishing C5 Recreational sea fishing offshore, the C6 Sport fishing competitions, C7 Commercial shipping C8 Registry of fishing vessels and recreational sea; C9 Infringements and Sanctions. I will explain later the most important matter of these chapters. Finally, the RD also includes 5 DA RD, 1DT, 1DD and 3DF, establishing the title of jurisdiction, the possibility of amending the Annexes and the entry into force.

4 Objeto la regulación de la práctica de la pesca marítima de recreo en aguas exteriores españolas, ENTENDIENDOSE LA MISMA COMO LA actividad pesquera no comercial que explota los recursos acuáticos vivos con fines recreativos de ocio THE PURPOSE OF THIS RD IS TO REGULATE THE PRACTICE OF RECREATIONAL SEA FISHING IN THE SPANISH OFFSHORE WATERS. THESE KINDS OF FISHING ACTIVITIES ARE DEFINED AS A NON COMMERCIAL FISHERIES, USING AQUATIC RESOURCES FOR LEIASURE.

Cantábrico y Noroeste Golfo de Cádiz Mediterránea Canarias This RD establishes and describes the marine areas to practice recreational fishing, and these are: the area of the Cantabrian and north-west, the Gulf of Cadiz, the Mediterranean area and the area outside the Canary Islands waters

6 Autorizaciones y obligaciones
En la pesca marítima de recreo: El Estado tiene la competencia en aguas exteriores Las Comunidades Autónomas en sus respectivas aguas interiores. Para evitar un doble régimen de autorizaciones, se opta por que sean las Comunidades Autónomas del litoral las que concedan las licencias para ejercitar esta actividad en aguas exteriores, y establecerán mecanismos de reconocimiento mutuo de licencias. As is written in the Spanish Constitution, the State Government is responsible for recreational sea fishing, if it is practiced in offshore waters, and the Regional Administrations are responsible for these activities in the rest of the sea waters (they are called internal waters). In order to control this activity, a licensing system has been established. It is based on operating licenses authorized only by the Regional Administrations, to avoid the duplication of the same authorization, and the Regional Government shall establish mechanisms for mutual recognition of licenses, as well as measures to cooperate and collaborate with the State Government.

7 Autorizaciones y obligaciones
EL EJERCICIO DE LA ACTIVIDAD DIRIGIDA A LAS especies sometidas a medidas de protección diferenciada REQUIERE: Autorización del Ministerio de Medio Ambiente y Medio Rural y Marino(MARM) Comunicación de los datos de Actividad , captura y suelta precisos para determinar el esfuerzo pesquero. THE RECREATIONAL FISHING DIRECTED TO SPECIES SUBJETED TO DIFFERENTIAL PROTECTION MEASURES REQUIRES: AN SPECIFIC AUTHORIZATION FROM THE MINISTRY OF ENVIROMENT AND RURAL AND MARINE AFFAIRS. A FORMALCOMUNICATION INCLUDING INFORMATION TO CONTROL THE FISHING EFFORT (CATCH DATA)

9 Especies autorizadas En el ejercicio de la pesca marítima de recreo sólo se podrán capturar aquellas especies autorizadas de peces y cefalópodos que aparecen en el anexo I del Real Decreto, debiendo respetar, en todo caso, las tallas mínimas y demás prescripciones técnicas que se regulan en su normativa específica. One of the novelties of this Royal Decree is to establish a positive list of species, contrary to the previous regulations. This list of species listed in Annex I, will be routinely reviewed and modified (if it is necessary), taking into account the results of scientific studies about the biological status of marine species. In any case the recreational fishing activities must respect the minimum size (Royal Decree 560/1995 of 7 April, establishing the minimum sizes of certain fish species of fish), and other technical requirements regulated in the specific legislation.

10 ESPECIES SOMETIDAS A MEDIDAS DE PROTECCIÓN DIFERENCIADA EN PESCA MARÍTIMA DE RECREO
In addition to the positive list of species, the RD includes a list of species subjected to differential protection measures. AR / AB / BIGEYE / swordfish / marlin / sailfish / HAKE Those species, subjected to differential protection measures, are regulated by specific legislation and by recovery plan.

Ejercicio de la actividad: Licencia expedida por el órgano competente de una Comunidad Autónoma del litoral o de las ciudades de Ceuta y Melilla Captura o tenencia a bordo de especies sometidas a medidas de protección diferenciada: Autorización específica expedida por la D.G. de Recursos Pesqueros y Acuicultura de la Secretaría General del Mar del MARM a solicitud del titular de la embarcación. Autorización a bordo de la embarcación cuando se vaya a realizar la actividad. Período de validez de tres años. Renovación con antelación mínima de tres meses. As we have seen recreational sea fishing could be practice from the boat. This type of fishing requires a license issued by the Regional Governments on whose coast is intended to carry the activity. For catching or keeping on board species subjected to differentiated protection measures ( Annex II), the owner of the boat must request an specific authorization to the Directorate General of Fisheries and Aquaculture of the Sea Secretary (Ministry of Environment And Rural and Marine Affairs). This authorization is valid for three years, however the technical requirements depending on the status of species and their regulations must be taken into account

desde embarcación Declaración de capturas y suelta: A remitir a la DG de Recursos Pesqueros y Acuicultura en los cinco primeros días de cada mes, incluso cuando no se hayan realizado capturas. Planes de recuperación: Las especies de protección diferenciada sometidas a un plan de recuperación se regularán por la normativa del mismo. The owners of vessels authorized by the Sea Secretary, must submit a declaration of catch or catch and release depending on the species, as a control measure.

14 Aparejos permitidos Línea de mano, caña, curricán, volantín, potera y aparejos accesorios para subir las piezas a bordo. El MARM, para cada zona de pesca, podrá autorizar otros aparejos y regular sus características técnicas. The RD established the allowed gears and Riggings: Hand line, rod, hooks and lines, kite, jigging and rigging accessories up the pieces on board. The MARM may authorize and regulate other gears and riggings for each fishing zone.

15 Prohibiciones En el ejercicio de esta modalidad de pesca marítima de recreo queda expresamente prohibido: La utilización o tenencia a bordo de artes, aparejos, útiles o instrumentos propios de la pesca profesional distintos de los relacionados en el apartado anterior. Interferir la práctica de la pesca profesional teniendo en cuenta la distancia mínima a: Embarcaciones profesionales: 300 m (0,162 millas náuticas) en general 500 m (0.269 millas náuticas) de los pesqueros con caña de túnidos Polígonos e instalaciones de acuicultura: 200m (0,107 millas náuticas) de la línea perimetral The RD includes several prohibitions: - To use or possession on board, gear, appliances, tools or instruments of professional fishing different than those listed in the previous section. - To Interfere with professional fishing, taking into account the minimum distance established in its specific regulations: Professional vessels:        In general: 300 m (0.162 nautical miles)        Tuna fishing using rods: 500 m (0.269 nm) Facilities for aquaculture   200m (0.107 nautical miles) taking into account the edge line

16 Prohibiciones El uso de más de dos carretes eléctricos por embarcación, cuya potencia máxima y longitud del sedal será establecida por orden del Ministerio. El empleo de cualquier medio de atracción o concentración artificial de las especies a capturar y de forma expresa el uso de luces , excepto el brumeo con pequeños pelágicos. El uso o tenencia de cualquier clase de sustancia venenosa, narcótica, explosiva o contaminante OTHER PROHIBITIONS: - The use of more tan two electric reels per boat. The maximum power and length of the line will be established by the Ministry.  - The use of measures to attract or concentrate the target species, specifically the use of lights, except with a traditional fisheries activities directed to small pelagic species called “brumeo”.  - The use or possession of poisons, narcotics, explosives or contaminants.

17 Pesca marítima de recreo submarina
la práctica de ESTA ACTIVIDAD requiere estar en posesión de la licencia CORRESPONDIENTE expedida por una comunidad autónoma del litoral o de las ciudades de Ceuta y Melilla, debiendo cumplir la normativa establecida por la administración en cuyo litoral se realice la actividad. Another type of fishing regulated is the Recreational Sea Fishing UNDERWATER: An specific license issued by the competent Regional Administrations is required to practice underwater recreational sea fishing. These activities must comply with the rules established by the competent Administration in each cost. Is only allowed to use traditional harpoon or mechanized harpoon with one or more points. The Sea Fishing underwater is prohibited if underwater breathing machines are carried simultaneously on the vessel Each diver must mark his position with a clearly visible buoy, which must not move away from a radius greater than nautical miles or 25 meters. Furthermore this kind of recreational fishing depends on these rules: The loaded gun must not be out of the water. Having a loaded gun out of the water. To use of instruments to capture which have explosive or electronic tips, as well as light source ( except for a flashlight) is prohibited. To use or hold hydrofoils artifacts and similar vehicles is prohibited. The practice of this activity at night, from sunset to sunrise is prohibited.

18 Concursos de Pesca La celebración de concursos de pesca marítima en aguas exteriores requerirá de una autorización que se concederá: Por la D.G de Recursos Pesqueros y Acuicultura en el supuesto de concursos de especies de protección diferenciada. Por la Comunidad Autónoma competente para la concesión de la correspondiente licencia de actividad en el resto de los concursos que deberán comunicar en el plazo de 15 días a la DG de Recursos Pesqueros y Acuicultura. RD regulates the recreational fishing sporting contests, establishing: A license is required, and depending on the target species these licenses will be issued by the Central Administration or by the Regional Government. The State Administration will give the license for species submitted to specific protection measures. The Regional Administration must communicate these activities to the Sea Secretary.

19 Concursos de especies de protección diferenciada.
La persona o entidad organizadora de estos concursos será responsable de la práctica de la captura y suelta de los ejemplares de especies de protección diferenciada sometidas a planes de recuperación que sean capturados vivos así como de los juveniles de las demás especies. Deberán remitir a la DG de Recursos Pesqueros y Acuicultura una declaración de las capturas y captura y suelta realizadas por cada embarcación y zona de pesca. Las capturas obtenidas no podrán ser vendidas ni cedidas a terceros para un fin comercial. The person or company who organized these activities will be also responsible for the cath and release of alive species submitted to specific protection measures, under recovery plan, as well as those specimens which do not comply the regulation about the minimum sizes. . They must also submit to the DG of Fisheries and Aquaculture the catch and catch-release statement which has to be filled out ​​by each boat and fishing area. The catches must not be sell or transferred to third parties for commercial purposes.

20 Embarcaciones comerciales de pesca marítima de recreo
Los titulares de las embarcaciones comerciales deberán remitir al Ministerio de Medio Ambiente y Medio Rural y Marino, un informe mensual sobre las capturas y suelta de especies de protección diferenciada realizadas por cada embarcación. The RD also regulates the activity of commercial vessels: The owner of these vessels must have the specific licence for this activity, which have to be issued by the competent Regional Goverment. If they want to catch species submitted to specific protection measures, they must have an specific authorization. In this case, the owners should send a monthly report about the cathes and release to Ministry of Enviroment and Rural Affairs.

21 Registro de embarcaciones de pesca marítima de recreo en aguas exteriores
Se crea en la DG de Ordenación Pesquera de la SGM del MARM, el Registro de embarcaciones de pesca marítima de recreo que se nutrirá de la relación de las embarcaciones que consten en los registros de embarcaciones recreativas de las Comunidades Autónomas con licencia en vigor para el ejercicio de la actividad de pesca recreativa desde embarcación en aguas exteriores, los cuáles deberán actualizarse, al menos, una vez al año. The future creation of the Register of Sea Recreational Fishing boats is a highlight novelty of this RD: The Directorate General of Fisheries Management of the Sea Secretary (Ministry of Environment and Rural and Marine Affairs), will create a Register of offshore recreational fishing boats. This Register will comprised the Regional Administration registers and must be updated at least once a year.

La Secretaria General del Mar ha desarrollado una tramitación telemática de la preceptiva autorización de la D.G. de Recursos Pesqueros y Acuicultura para la captura o tenencia a bordo de especies sometidas a medidas de protección diferenciada: Embarcaciones que practican la pesca marítima de recreo(Lista 7ª) Embarcaciones comerciales de pesca marítima de recreo (Lista 6ª) Organizaciones que convocan Concursos de pesca de especie de protección diferenciada Esta tramitación es accesible desde la Sede Electrónica del Portal del MARM http: // @ SEDE ELECTRONICA PROCEDIMIENTOS BUSQUEDA : PESCA RECREATIVA The RD aimed to eliminate red tape and facilitate public access, specially to request authorization. The Sea Secretary has developed an online process to request authorization from the DG of Fisheries and Aquaculture for catching or keeping on board of species subject to differential protection measures. This process can be used by: - Fishing vessels engaged in recreational sea (Schedule 7 th) -   Commercial vessels of recreational sea fishing (List 6 th)  -   The Companies which organize recreational fishing competition with species submitted to specific protection measures. This processing is accessible from the MINISTRY Electronic Office Portal http: //

23 EXPECTATIVAS Y CONCLUSIONES
SE PRETENDE ESTABLECER EN ESTE REAL DECRETO LAS NORMAS GENERALES APLICABLES A LA PESCA MARITIMA DE RECREO PARA TODAS LAS ZONAS DE PESCA. SE IMPLANTAN MEDIDAS BÁSICAS DE CONTROL DE ESTA ACTIVIDAD CON LA FINALIDAD DE ESCLARECER EL IMPACTO DE LA PESCA RECREATIVA SOBRE LOS RECURSOS PESQUEROS REALIZAR ESTUDIOS DE IMPACTO SOCIOECONOMICO DEL SECTOR RECREATIVO Finally I will discuss the conclusions and expectations related to this new regulation, which are: - THE AIM IS TO ESTABLISH GENERAL RULES APPLIED TO THE MARINE RECREATIONAL FISHING FOR ALL FISHERIES AREAS. -BASIC CONTRL MEASURES OF THESE ACTIVITIES ARE IMPLEMENTED IN ORDER TO CLARIFY THE IMPACT OF RECREATIONAL FISHING ON FISHERY RESOURCES - STUDIES ABOUT THE SOCIO-ECONOMIC IMPACT ON THE RECREATIONAL FISHERIES SECTOR COULD BE CARRIED OUT.
