3 Comprehensive Migration Policy Page 3 The substantive contents of the Regional Migration Policy reflect the needs relating to migration that should be addressed in SICA countries.

4 Who Participated? Page 4 The policy was jointly developed by Ministries of Foreign Affairs and General Directorates of Migration, with technical assistance of the International Organization for Migration (IOM). In addition, other relevant sectors were consulted, such as the health, labour, and tourism sector, among others.

5 What are the Contents? Page 5 The broad content areas of the Regional Migration Policy are as follows: Regional immigration system Labour migration Assistance to vulnerable migrant populations Migrant smuggling and trafficking Extraregional migration Vision and position of the region at an international level Economy Social integration Tourism

6 Spheres of the Comprehensive Regional Migration Policy Page 6 Sistema de inmigración regional El sistema de visados: Se definirán los protocolos, procedimientos y mecanismos para la armonización de los requisitos para el otorgamiento de visa en la región. El intercambio de la información: se desarrollarán aplicaciones informáticas, a través del establecimiento de criterios para el intercambio de información migratoria y las estadísticas regionales, que protejan y aseguren la confidencialidad de la información y de los datos. La armonización de tramites: se definirán las áreas de acción que se deban armonizar. Visa System: Protocols, procedures, and mechanisms will be established to harmonize visa requirements in the region. Information Exchange: Computer software will be developed, establishing criteria for migration information exchange and regional statistics in order to protect and guarantee the confidentiality of data and information. Harmonizing Procedures: The areas of action to be harmonized will be established. Regional Immigration System

7 Page 7 Sistema de inmigración regional Con las poblaciones transfronterizas: Se flexibilizarán los requisitos y aranceles de la población transfronteriza con el objeto de documentar y facilitar la movilidad de esa población, fortaleciendo las relaciones comunitarias. El Refugio: Se armonizarán los criterios para el otorgamiento de la condición de refugiado, así como profundizar en las corresponsabilidades de adoptar las medidas pertinentes, en un marco de flujos migratorios mixtos. La deportación y detención: Se fortalecerán las condiciones y los mecanismos para el tratamiento de los casos de deportación, detención y retorno. Spheres of the Comprehensive Regional Migration Policy Regional Immigration System With Cross-Border Populations: Requirements and tariffs will be made flexible for cross-border populations, with the objective of documenting and facilitating the movement of these populations, thus strengthening community relations. Refugee Status: Criteria for granting refugee status will be harmonized, and the topic of shared responsibility in adopting appropriate actions within the framework of mixed migration flows will be further addressed. Deportation and Detention: Conditions and mechanisms to address cases of deportation, detention, and return will be strengthened.

Se impulsarán acciones orientadas a la gestión circular ordenada de los flujos migratorios laborales. Se estimularán acciones orientadas hacia la comprensión de las causas de la migración irregular y la facilitación de los procesos de regularización. Spheres of the Comprehensive Regional Migration Policy Labour Migration The establishment of bilateral agreements will be promoted to foster the comprehensive migration management of labour migration flows. Actions oriented toward the circular orderly management of labour migration flows will be promoted. Actions oriented toward understanding the causes of irregular migration and facilitating regularization processes will be promoted. Incentives will be established to promote the proactive participation of the private sector in protecting the labour rights of migrants.

9 Page 9 Asistencia a poblaciones migrantes vulnerables Trata y trafico ilícito de personas Se dará protección y atención a las victimas de trata de personas en todas sus modalidades existentes en la región incluyendo la trata interna a través de un enfoque victimológico. Se fortalecerán los marcos jurídicos sobre la regulación de la trata de personas en todas sus modalidades existentes en la región, incluyendo la trata interna. Se tendrá una estrategia de difusión del delito de trata de personas trafico y sensibilización a nivel regional. Assistance to Vulnerable Migrant Populations Trafficking in Persons and Migrant Smuggling Protection and assistance will be provided to victims of all types of trafficking in persons that exist in the region, including internal trafficking, with a victim-centred approach. Legal frameworks on regulation relating to all types of trafficking in persons that exist in the region, including internal trafficking, will be strengthened. A strategy will be in place to disseminate information and raise awareness on the crime of trafficking in persons and migrant smuggling at a regional level. 10 Page 10 Asistencia a poblaciones migrantes vulnerables Trata y trafico ilícito de personas Se fortalecerá la institucionalidad en la región en el marco de la trata de personas y el trafico ilícito de personas. Se definirán los procedimientos de actuación para la coordinación efectiva y eficaz en la prevención atención y combate al delito de trafico ilícito de migrantes. Se dará asistencia especial a poblaciones migrantes vulnerables entre estos niños, niñas y adolescentes no acompañados, mujeres embarazadas, discapacitados entre otros. Spheres of the Comprehensive Regional Migration Policy Institutionality will be strengthened in the region, within the framework of trafficking in persons and migrant smuggling. Procedures will be established for an effective and efficient coordination in preventing, providing assistance, and combating the crime of migrant smuggling. Assistance to Vulnerable Migrant Populations Trafficking in Persons and Migrant Smuggling Special assistance will be provided to vulnerable migrant populations, including unaccompanied boys, girls, and adolescents, pregnant women, disabled persons, etc.

11 Page 11 Migración extra- regional Se iniciará un dialogo regional para la definición de acciones conjuntas en respuesta a la migración extra- regionales hacia Centroamérica. Creación de consulados conjuntos (Guatemala –El salvador Spheres of the Comprehensive Regional Migration Policy Extra- regional Migration A regional dialogue will be initiated to establish joint actions to address extraregional migration in Central America. Establishing joint consulates ( Guatemala – El Salvador)

12 Page 12 Postura de la región a nivel internacional Se definirán acciones conjuntas orientadas a la generación de un posicionamiento regional sobre ciertos temas. Se fomentarán acciones orientadas a fortalecer las capacidades de negociación de la región a nivel internacional. Se impulsar acciones orientadas a fortalecer el vinculo entre los países de la región y sus connacionales en el exterior. Spheres of the Comprehensive Regional Migration Policy Position of the Region at an International Level Joint actions will be established oriented toward developing a regional position in regard to certain topics. Actions will be promoted to strengthen capacities to conduct negotiations at an international level in the region. Actions will be promoted to strengthen the links between countries in the region and national citizens from these countries that are living abroad.

13 Page 13 Economía Se fortalecerá la articulación entre las necesidades del sector económico y la gestión de la migración laboral. Se generarán incentivos a la gestión productiva a nivel regional mediante el fortalecimiento de una gestión migratoria apta para responder a los planes nacionales de desarrollo. Spheres of the Comprehensive Regional Migration Policy Coordination will be strengthened in regard to the needs of the economic sector and labour migration management. Incentives will be created for productive management at a regional level, oriented toward achieving an appropriate migration management in accordance with national development plans. Economy

14 Page 14 Integración social Se fortalecerá los mecanismos de certificación de capacidades en los países de origen y de reconocimiento de los títulos profesionales, con el fin de facilitar la inserción laboral productiva de las personas migrantes en los países de destino. Se fomentará la creación de grupos de trabajo inter- institucional regional con el propósito de identificar las oportunidades y los obstáculos a la facilitación del acceso de las personas migrantes a servicios sociales primarios y a la portabilidad de los beneficios de seguro social. Se desarrollarán mecanismos que facilitan la obtención de la documentación requerida (ej.: certificado de nacimiento) para la inscripción en centros escolares de los niños y niñas de los trabajadores migrantes. Spheres of the Comprehensive Regional Migration Policy Social Integration Mechanisms will be strengthened to certify capacities and to recognize professional degrees in countries of origin, with the aim of facilitating the productive labour integration of migrants in countries of destination. The establishment of inter-institutional regional working groups will be promoted, with the purpose of identifying opportunities and obstacles to facilitate access of migrants to primary social services and portability of social security benefits. Mechanisms will be developed to facilitate obtaining the documents (for example, birth certificates) that are required to enrol children of migrants in schools.

15 Page 15 Turismo Turismo y libre movilidad: Se facilitará el ingreso de los turistas a través de la correlación interinstitucional con el objeto de modernizar los controles migratorios a través del uso de herramientas de información tecnológica. Spheres of the Comprehensive Regional Migration Policy Tourism and Free Movement: The entry of tourists will be facilitated through inter-institutional coordination aimed at modernizing immigration controls through the use of information technology tools. Tourism

16 Page 16 Formulating a Comprehensive Regional Migration Policy constitutes a significant step toward strengthening migration management in Central America and harmonizing legislation in the region.
